For paid subscriptions, you may subscribe by using one of the methods made available from time to time (e.g. telephone, mail, online, or other), and we will use the information provided to create your subscription account (although this will not include digital access unless you create an online account as noted above).

Free Services

Subscriptions to some of our email newsletters may be available free of charge, however, certain Content may only be available to those with a valid paid subscription.  You may subscribe to our free email newsletters or certain limited trial subscriptions by creating an account and providing personal information as indicated, as well as your agreement to applicable subscription terms. However, if you do not purchase a paid subscription, you may not have access to certain Gazette Content reserved for paid subscribers.

Print Publications

If you purchase a subscription to our print publication, please understand that your delivery will not begin until we publish the next issue of our print publication. The delivery of our print products is subject to the availability and capacity of our delivery partners. There may be variability or delays in the dates and times of delivery of our print publication. In addition, in certain locations and for certain print products, we may depend on the United States Postal Service or international postal services to provide delivery by mail, which may result in additional variability in dates and times of delivery or, in some cases, delays. Any suspension of print delivery does not affect your digital access or your subscription term and no credit will be provided.

Subscription Duration and Publishing Schedule

Print and digital subscriptions may be based either on a length of term (e.g. 13 weeks, 3 months, or may be based on receipt of a specific number of digital publications or “issues” under that subscription).  Digital only subscribers shall have digital content access for the subscribed period of time. Print and Digital subscribers will be provided access to the applicable website Content and/or Mobile Application and be provided any print or e-editions published during their applicable subscription period.  Print and e-edition issue frequency is subject to change at The Gazette’s sole discretion and modifications shall not affect the length of the subscriber’s subscription term.

Digital Services

After purchasing or otherwise registering for one of our digital subscriptions (either alone or bundled with a print subscription), your digital products will either require that you log in to the Site through which that subscription is offered (e.g. for our AI Services), or if the subscription is for digital publications, they will be delivered to the email address you provided, starting with the next publication of the digital publication to which you have subscribed, or in the future we may deliver digital products through our Mobile Applications or other means, depending on the nature of your subscription.

Modifications

We reserve the right to modify the content, type and availability of any digital product or print publication at any time. We also reserve the right to designate certain free newsletters or other Content as part of a paid subscription at any time. If you do not agree to the modifications, you may cancel your subscription through the methods explained below.  Please see Changes to Subscriptions below for further details.

AI Subscriptions

If you have subscribed to one of our subscriptions including “AI Services”, please note that we rely on certain third-party large language AI models (our “AI Partners”) in providing the AI Services. Accordingly, your use of our AI Services will be subject to the terms of the applicable AI Partners, as set forth in our Terms of Service.

If you use our AI Services, you may have the ability to modify certain settings associated with your account. These settings may change the data visible to us. Unless you modify your account settings, when you input a prompt into our AI Services, we will be able to associate that prompt with your account. However, when the prompt is sent to our AI Partners, your IP address and account information is not visible to them, so they will not be able to associate your prompts and resulting reports or output with your account (only that it came from one of the Gazette’s users).

Although our AI Services have been developed to rely on information generated by the Gazette, it is well known that large language AI models have been known to “hallucinate” by creating answers not based on the facts contained within training data.  Accordingly, it is your responsibility to verify the content of any output you receive from the AI Services against other sources, and we will not be liable for the content of any output received from our AI Services.

Payments and Pricing

All prices are stated in U.S. Dollars, and are subject to change over time.  We will provide you written notice (via email or other means) prior to any price change. We currently accept various credit cards, debit cards, and certain digital methods of payment (each, a “Payment Method”), however, the Payment Methods accepted may change over time. You agree to pay all charges incurred by you or any users of your account and Payment Method at the price(s) in effect when such charges are incurred. You may also be responsible for paying any applicable taxes relating to your purchases. Subscription purchases must be paid in full at the time of purchase, unless a payment plan or bill me later option is offered and entered into at the time of purchase (for example, if you subscribe on a monthly payment plan).

We reserve the right to reject any order or purchase at any time. By providing payment information to us, you agree that the payment information is valid. We will process your purchase as quickly as possible; however, the activation of your subscription may be delayed while payment details are verified.

If your initial payment authorization is later withdrawn or becomes invalid, your subscription will cease and we may (but are not obligated to) provide you “grace copies” as described below.  However, if you do not pay the billed amount when indicated, your print subscription and/or digital access may be terminated. You may email customercare@gazette.com if you believe your access was terminated in error.

Unless expressly specified otherwise in these Subscription Terms or in the terms to which you agreed when you subscribed for a Service, all charges are nonrefundable.

To view or change your payment method, login to your subscription portal on the applicable Site or call our customer service number at 866-632-6397. All fees are payable in accordance with the payment terms in effect when the fees become payable.

We may receive updated credit card information (new credit card number or updated expiration date) from your credit card issuer. We may use these new details in order to help prevent any interruption to your subscriptions. The disbursement of the updated credit card information is provided to us at the election of your credit card issuer. We are not responsible for the distribution of your updated credit card information. Your credit card issuer may give you the right to opt out of the updated service. It is your responsibility to contact your credit card issuer regarding your right to opt out of the updated service.

Applicable taxes may vary depending on the jurisdiction. We may not be able to notify you in advance of changes in applicable taxes.

Your subscription may include additional ancillary charges above the offered subscription price and term.

Your subscription may include a separate initial activation fee for new or returning customers. This activation fee will be disclosed and charged upon checkout.

If you do not opt-out, the Special Magazines will automatically be billed to your account and will affect your expiration date.

Pricing and Other Errors

If the amount that you pay for a subscription is obviously incorrect, regardless of whether it is an error in a price posted on the Service or otherwise communicated to you, then we reserve the right, at our sole discretion and as your sole remedy, to cancel your order and refund to you the amount that you paid. This policy will apply regardless of how the error occurred.

Other Credits

At the Gazette’s sole discretion, other credits may be provided for failure of delivery or other subscription issues.  Any request for credit must be made within five (5) days of the delivery or other issue.

Subscription Payments and Billing

Grace Copies

If your payment method becomes invalid or your subscription expires, we may provide a grace period or grace copies (subject to change at our sole discretion).  If a renewal occurs, a portion of that renewal shall be applied to the grace period or grace copies already served and the subscription will begin at the time of the prior subscription’s termination.

Auto-Renewal

If you purchase a subscription, you are subscribing to an automatically renewing subscription requiring recurring payments at the stated frequency until you cancel in the manner set forth below. All print and digital renewals shall be renewed based on a corresponding length of term or number of issues to your prior subscription (e.g. 12 months) unless otherwise noted in your offer and shall be fulfilled in accordance with the Publishing Schedule detailed above.  You authorize us to charge your subscription fees as indicated when you sign up and as otherwise described in these Subscription Terms, as well as any applicable taxes, on or after the date you purchase your subscription. If you initially subscribed at a promotional rate, the renewal will be at the full rate as stated in the terms or otherwise offered to which you agreed at the time of subscription.  Unless otherwise required by applicable law, your subscription will be automatically renewed unless you tell us to stop. If your subscription will expire due to lack of payment you will be sent a renewal notice stating the term and rate then in effect.  All other subscribers will be notified in accordance to applicable law.  If you do nothing, your credit/debit card will be charged at the agreed upon renewal rate and term unless otherwise notified. Subscribers may cancel online at any time during your subscription by emailing customercare@gazette.com or logging in to your online account and cancelling your subscription.  If you cancel your subscription, you will not be entitled to any refund. By clicking the checkbox or otherwise indicating your agreement when you subscribed to the Service you agree to this recurring charge.

In-App Purchases & Subscriptions

Our Mobile Applications may be downloaded free of charge, however, certain Content may only be available to registered users or those with a valid subscription. Our Mobile Applications may allow you to subscribe to Content through an “in-app purchase” at the cost indicated in the Mobile Application. If you choose to subscribe using the in-app purchase, the operator of the Mobile Application store will process your payment, subject to the Terms of Use and Privacy Policies of the processing party. The Gazette is not responsible for purchases made in Mobile Application stores other than those initiated using our Mobile Applications.

Changes to Subscriptions

The subscription terms or fees may be changed by us at any time in the future in our sole discretion, and we will provide you notice of changes if required by applicable law. If we increase the pricing for your subscription beyond the initial subscription or renewal terms, we will notify you and give you an opportunity to change or cancel your subscription before applying those changes to your account or charging you in connection with an automatic renewal. We may choose in our sole discretion to add, modify, or remove features from a subscription or service on a temporary or permanent basis. If you do not wish to continue subscribing with the new modifications, you may cancel your subscription. Your continued use of our Service after the changes become effective will constitute your acceptance of the changes. If you accept the new subscription and/or fees, the new subscription terms will apply for that renewal and all renewals going forward.

CANCELLATION POLICY

If you cancel prior to the deadline, you will not be charged or you will be eligible to receive a refund for additional charges. For subscriptions that are canceled within a free trial period, your cancellation will become effective immediately; for all other subscriptions your cancellation will become effective at the end of your current subscription period, and you will continue to have access to your subscription for the remainder of the subscription period.

EXCEPT AS OTHERWISE STATED IN THESE SUBSCRIPTION TERMS OR AS REQUIRED BY APPLICABLE LAW, YOUR SUBSCRIPTION FEE IS NONREFUNDABLE. If you cancel your subscription, you are not entitled to receive any refund or credits for the time remaining in your subscription period. Certain products sold as part of a promotion may have different cancellation or refund policies that will be made clear at the time of purchase or otherwise before they become effective.

Suspensions or Cancellations by Us

Without limiting any other remedies, we reserve the right to suspend or terminate your subscription or product or portion thereof for any reason, with or without notice and without further obligation. If we cancel your subscription, we may provide you a pro-rated refund based on the amount of time remaining that you cannot use. However, we will not be obligated to grant you a refund if we terminate your subscription because we determine, in our sole discretion, that your actions or your use of a Subscription Service violate these Subscription Terms or our applicable Terms of Service, any applicable law, or has harmed the service, product, or another user. If any or all of our digital products are temporarily unavailable, you will not receive a refund. We reserve the right to issue refunds or credits at our sole discretion.

We reserve the right to terminate a subscription if your Payment Method becomes invalid, or if we otherwise do not receive payment for your subscription when due.  However, we are not obligated to, and we may choose not to, automatically terminate your account in the event that your credit card expires or your payment method is otherwise invalid. You will remain responsible for all charges and uncollected amounts incurred until you cancel or we, in our sole discretion, decide to terminate your account. In addition, we reserve the right to collect from you all costs we incur in connection with the collection of unpaid amounts, including court costs, attorneys’ fees, collection agency fees, and any other associated costs.

When you change your subscription, you may receive a pro-rated credit for fees paid in advance for your prior subscription that will be used toward your new subscription, at our sole discretion. If you cancel your subscription prior to using all of the pro-rated credit, then you may no longer have access to any unused portion of that credit.

Cancellation and Refunds of One-Time Purchases

Unless specified otherwise in these Subscription Terms, one-time purchases cannot be canceled or refunded. For more information on the cancellation terms for gift subscriptions, email us at customercare@gazette.com. If we issue a discretionary refund or credit, we are under no obligation to issue the same or similar refund in the future.

Dispute Resolution, Arbitration. Class Waiver

Any dispute arising out of or relating in any way to these Subscription Terms or your use of our Subscription Services, or information you receive through or in connection with our Subscription Services, shall be submitted to confidential, binding arbitration in Colorado Springs, Colorado, USA, or, at your election, in the county seat of the county within the USA where you reside. The arbitrator’s award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Each party shall bear its own costs and fees in connection with any arbitration, including all filing and arbitrator fees. The arbitrator shall have no authority to award punitive, exemplary, or multiplied damages against The Gazette. In the event that a claim is determined by the arbitrator to be frivolous or brought in bad faith, the claimant shall reimburse The Gazette for all costs and attorneys’ fees incurred in defending such claim. All arbitration proceedings shall be conducted solely in written form, and no in-person or video hearings shall be held unless agreed to in writing by The Gazette. No arbitration under these Subscription Terms may be joined with another arbitration related to the subject matter hereof. Notwithstanding the foregoing arbitration requirement, with regard to any actual or potential violation of our intellectual property rights, we may seek injunctive or other appropriate relief in the courts of Colorado Springs, Colorado, USA, and you hereby consent to the exclusive jurisdiction of such courts and waive all objections thereto. We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. The following processes shall govern the arbitration:

•          Before commencing an arbitration, you agree to inform us of the nature of the claim and the relief you seek by sending an email to legal@gazette.com so stating.

•          Within seven (7) days, The Gazette will contact you and thereafter you and we will attempt to resolve the claim or issue in a satisfactory way.

•          If, following these attempts at exploring a resolution, you intend to proceed with an arbitration claim, you and we will seek to reach an agreement on the selection of an arbitrator to hear and decide the dispute and how it will be heard, including whether to submit the dispute to the arbitrator only in written form, by proceedings conducted via video or in-person.

•          In the event that you and we cannot agree on an arbitrator, the process set forth in Section 11(a) of the Uniform Arbitration Act, or any comparable provision in your state will be followed.

GOVERNING LAW

Except as otherwise required by applicable law, these Subscription Terms and any dispute arising out of or relating to them shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of laws principles. Subject to the arbitration clause above, each party irrevocably submits to the exclusive jurisdiction of the state and federal courts located in El Paso County, Colorado for resolution of any dispute not subject to arbitration. You irrevocably submit to the exclusive personal jurisdiction of such courts and waive any objection to the laying of venue of any such proceeding in such courts, including any objection that such courts are an inconvenient forum
