On the docket this week: Cog Railway assault suspect back in court
After a slow week in the 4th Judicial District due to the Thanksgiving holiday, the docket schedule resumes in full force.
This week, the robbery suspect seriously injured in a shooting with police in September 2024, and the Pueblo man charged with first-degree murder in the shooting death of Andrea Martinez, are back in court, along with others.
Here is the rundown.
Monday
Brenden Burningham is back in court Monday for sentencing after pleading guilty to felony robbery in September.
The case for Burningham, 32, started in September 2024, when Fountain police officers received reports of a robbery in progress at the Walgreens along 7910 Fountain Mesa Road. The reports indicated the suspect had threatened employees, and was armed with a gun and a bomb.
According to previous Gazette reporting, after taking items from the store, the suspect fled on foot from the store toward a nearby Lowe’s store. According to the Police Department, officers attempted to apprehend the suspect in the parking lot of a nearby Chase Bank.
“That is when two officers fired at least one round each, striking the suspect,” the department said in a news release.
Fountain police officers involved in the shooting were placed on administrative leave, and the shooting was ruled justified in April by the 4th Judicial District.
Tuesday
Alehandro Chacon is set for a preliminary hearing Tuesday, during which prosecutors will have the chance to show new evidence into the August homicide that left Andrea Martinez, 47, dead.
However, Chacon can waive the hearing, blocking any new details from being introduced. Little information is known about the case.
Chacon, 21, was taken into custody in September after Pueblo police and the U.S. Marshals Service obtained a warrant for his arrest. Martinez was shot and killed Aug. 14 in the 1600 block of Spruce Street, authorities said. Her death was Pueblo’s ninth homicide in 2025.
Chacon was booked into the Pueblo County jail, where he remains with a cash-only bond set at $1 million as of Friday. He faces several felony charges, including first-degree murder.
Thursday
The suspect in the Broadmoor Manitou & Pikes Peak Cog Railway attack is back in court for his arraignment Thursday, during which he is expected to enter a plea. Randy Blevins, 50, of Arvada, is accused of assaulting a parking lot employee, leaving the victim hospitalized with serious injuries.
According to previous Gazette coverage, the situation started on Aug. 18, when Blevins and his wife were walking through the Cog Railway parking lot after completing the Manitou Incline hike that morning.
Both witness statements and surveillance footage introduced at the October preliminary hearing were consistent, describing how three parking lot attendants started to follow the Blevins couple and “yell” at the pair to leave, because they were trespassing.
It is unclear whether there was an altercation beforehand, but some witnesses reported that the victim grabbed Blevins by the backpack or shirt and “swung” him around in the other direction in an attempt to get him to leave. Witness statements vary on the victim’s level of aggressiveness.
Other witness statements, including those from Blevins, indicated the victim had punched Blevins first, but others stated the opposite.
